TERMS OF SERVICE
What the service is
iNotarize provides intake, review, coordination, and case management for Remote Online Notarization requests, and arranges notarial acts performed by commissioned electronic notaries. Uploading a document is not itself a notarization, and submitting a request does not create an appointment or guarantee eligibility.
No legal advice
iNotarize provides notarial services and educational information. Notaries are not acting as attorneys and cannot provide legal advice, select legal documents for customers, or advise regarding the legal effect of a document unless separately authorized. Nothing on this site is legal advice.
Eligibility and review
Submitting a document does not guarantee that the document or transaction is eligible for Remote Online Notarization. We review each request and may decline one, including where a document requires a paper original or an in-person appearance, where identity cannot be verified as required, or where completing the act would be improper.
Your responsibilities
- Provide accurate information, including your true physical location
- Submit documents you have the right to submit
- Present valid, unexpired government-issued identification
- Do not submit unlawful content or attempt to interfere with the service
- Confirm with the receiving organization what it will accept
No guarantee of acceptance
We do not guarantee that any court, recorder, lender, title company, government agency, foreign government, embassy, consulate, or other receiving organization will accept a specific electronically notarized document. Confirm acceptance requirements with that organization before your appointment.
Fees
Applicable notarial fees and any permitted service or platform charges will be disclosed to you before the notarial act is performed.
Electronic records and signatures
You consent to conducting this transaction electronically, including electronic records and electronic signatures. See our electronic communications disclosure.
Limitation of liability
To the extent permitted by law, iNotarize is not liable for indirect, incidental, or consequential damages, including losses arising from a receiving organization's refusal to accept a document or from delays outside our control.
Changes
We may update these terms as the service changes. Continued use after an update constitutes acceptance of the revised terms.
